Legal Suit Clarifications

(Rio de Janeiro, february 09, 2007). – PETRÓLEO BRASILEIRO S/A - PETROBRAS, [Bovespa: PETR3/PETR4, NYSE: PBR/PBRA, Latibex: XPBR/XPBRA, BCBA: APBR/APBRA], a Brazilian international energy company, announces it will appeal the first instance decision handed down by the Rio de Janeiro Judiciary regarding compensating fishermen as a result of the accident that occurred in the Guanabara Bay, in 2000. The company argues that:

1 – At the time, Petrobras compensated, extra-judicially, all of those who proved to be fishermen at the time of the accident.

2 – According to the national fishermen reference file records, of the some 12,000 listed in the above-mentioned decision, only 3,339 could demand compensation for to the Petrobras accident at the time of the accident in 2000.

3 – The company also questions the payment of compensations for a 10-year period, since 30 days after the accident, a technical inspection carried out by universities and environmental agencies approved fishing to be retaken at the Guanabara Bay.
